Terms of Service
Initial draft · Last updated September 18, 2026
These draft terms describe the intended conditions for using newton.garden, the Newton Mac app, Appleseed, and the account and connection services provided with them (together, “Newton”). Newton is an independent software project operated by Shelby Klein (“we,” “us,” or “our”). This initial version is being reviewed and may be revised before it is finalized.
Using Newton
You must be at least 18 and able to enter into an agreement to use Newton. If you use it for an organization, you must be authorized to act for that organization. Keep your account information accurate, protect your credentials and paired devices, and tell us if you believe your access has been compromised.
Subject to the access granted to your account and these terms, you may install and use Newton for your own personal or internal business work. Access limits, eligible devices, update availability, and included services are those shown in your account or offer. An invitation, request for access, or roadmap item is not a guarantee of access or a future feature.
Your work and your responsibilities
You retain your rights in the materials you bring to Newton. We do not claim ownership of your branch files, prompts, or other original work. You authorize the processing needed to provide the features you choose, including passing instructions and selected materials to connected providers and tools. Rights in generated output also depend on applicable law and the relevant provider’s terms.
- Only use material and connect accounts you have permission to use. Respect others’ privacy, intellectual property, and confidentiality.
- Review instructions, selected files, destinations, and permissions before running work. You are responsible for actions you authorize, including edits, sends, uploads, and publishing.
- Keep backups of important work. Local organization, saved conversations, and session recovery are not a backup guarantee.
- Do not use Newton for unlawful activity, fraud, harassment, unauthorized access, malware, or interference with the service. Do not bypass account restrictions or attempt to access another person’s data.
AI providers and connected services
Newton can work with independently supplied models, command-line tools, accounts, and integrations. You obtain and maintain any required access to those services, pay their charges, and follow their terms. A Newton purchase does not include a provider subscription, model credits, or unlimited AI usage unless an offer expressly says so.
AI output may be incorrect, incomplete, unsafe, or unsuitable. Check it before relying on it, especially before changing code, publishing content, spending money, or making consequential decisions. Newton does not provide professional legal, medical, or financial advice. A tool being listed does not guarantee it is available or working.
Connected services can change their models, interfaces, pricing, policies, and availability. We do not control those changes. A branch does not itself sandbox all filesystem access or isolate shared external accounts; provider and operating-system permissions still matter.
Purchases, renewals, and cancellation
When paid access is offered, the price, currency, billing interval, applicable taxes, and included benefits are disclosed before purchase. Payments may be handled by Stripe. A recurring plan renews on the terms shown at checkout unless you cancel; a one-time purchase does not create a recurring subscription.
You can use the account’s billing controls when available, or contact us for help with cancellation. Removing the app or disconnecting a device does not by itself cancel a subscription. Cancellation stops future renewals; remaining access and refund eligibility follow the offer, any applicable refund policy, and mandatory consumer law.
A one-time purchase includes only the version or update entitlement described in the offer. No purchase promises perpetual hosted service, every future release, or a feature shown as experimental. Material changes to recurring prices or paid terms will be communicated before they apply, with any notice and cancellation rights required by law.
Preview and experimental features
Newton may be provided as an early release. Preview features can change, contain defects, or become unavailable. Experimental images and descriptions are design studies, not working features or delivery commitments. Keep important work backed up and review results before using them elsewhere.
Scheduled work and phone access depend on the host Mac, its connectivity, permissions, and the background service. Closing a window, restarting a process, and shutting down a Mac have different effects. We do not promise uninterrupted operation or automatic recovery of every in-progress action.
Software, feedback, and other licenses
Newton’s software, branding, and website remain the property of their respective owners. Third-party and open-source components retain their own licenses; nothing here removes rights those licenses grant. You may not redistribute or commercially resell access to Newton except where permitted by the applicable license or a separate agreement.
If you send suggestions, you allow us to use them to improve Newton without an obligation to pay for or implement them. This permission does not transfer ownership of your underlying project materials. Issue reports and attachments are visible to people with access to the relevant repository, and may become public if published. Do not include passwords, tokens, personal data, or confidential work.
Privacy
The Privacy Policy explains website, account, device, analytics, and connected-service data handling. Provider privacy policies also apply when you use their services. You are responsible for having an appropriate basis to process other people’s information in your projects.
Availability, suspension, and ending use
You may stop using Newton at any time. Contact us about account closure and use the appropriate billing controls to cancel paid renewals. Account closure, subscription cancellation, and deleting local project files are separate actions.
We may restrict access when reasonably necessary to address abuse, security risks, nonpayment, legal requirements, or a material breach of these terms. Where practical and appropriate, we will explain the restriction and give you an opportunity to resolve it. Changes or discontinuation of paid services remain subject to your applicable contractual and statutory rights.
Warranties and responsibility for loss
To the extent permitted by law, Newton is provided on an “as is” and “as available” basis, without a promise of error-free operation, fitness for a particular purpose, or the accuracy of generated content. You remain responsible for checking outputs, permissions, and backups.
To the extent permitted by law, we are not responsible for indirect or consequential losses arising from use of Newton, such as lost profits, or for failures of independently supplied services. Nothing in these terms excludes liability that cannot lawfully be excluded, or limits mandatory warranties, remedies, or consumer rights.
Changes, questions, and disputes
We may update these terms as Newton develops. The date above identifies this version; material changes will be communicated where required. Changes will not remove accrued rights or apply retroactively where prohibited. If a provision is unenforceable, the remaining provisions continue to apply to the extent allowed by law.
Please contact us first about a problem so we can try to resolve it. These draft terms do not impose mandatory arbitration, a class-action waiver, or a particular court location. Applicable law and any non-waivable rights in your place of residence remain relevant.
For account, billing, or privacy questions, contact Shelby Klein through your existing Newton invitation or support conversation. A dedicated public contact address will be added after review. Do not post private account details or privacy-request documents in issue reports.
